Our offerings may include, but are not limited to:

• Group mastermind communities (such as Circle Mastermind)

3. Program-Specific and Product-Specific Terms

Certain Three Ascend offerings — including but not limited to Built to Scale, Circle Mastermind, and any mobile or web application we operate (such as Her Promise) — may be governed by additional terms, agreements, or disclosures specific to that program or product.

Where such program-specific or product-specific terms exist, they supplement these general Terms and Conditions. In the event of a direct conflict between these general Terms and a program-specific or product-specific term regarding a matter specific to that offering, the program-specific or product-specific term will control for that matter.

4. Advisory, Coaching, and Consulting Disclaimer

Three Ascend provides advisory, coaching, consulting, education, strategy, accountability, and business or technology guidance. Our services are not a substitute for legal, tax, financial, accounting, medical, mental health, therapy, or other licensed professional advice.

You understand and agree that:

• We do not provide legal, tax, financial, investment, medical, or therapeutic services.

• Advisory, coaching, and consulting are collaborative processes that require your honest participation, implementation, decision-making, and follow-through.

• You remain solely responsible for your business decisions, actions, outcomes, and results.

• You should consult qualified licensed professionals before making legal, financial, tax, medical, therapeutic, or other regulated decisions.
  

5. No Guarantee of Results

Three Ascend is committed to providing strong advisory, coaching, and consulting support, strategic guidance, tools, frameworks, technology, and accountability. However, we do not guarantee any specific business, financial, personal, operational, emotional, revenue, client-acquisition, or growth outcome.

Results vary based on many factors, including your business model, market conditions, offer quality, pricing, audience, consistency, implementation, prior experience, resources, team, decision-making, and external circumstances outside our control.

Any examples, testimonials, case studies, projections, or references to potential outcomes are illustrative only and do not guarantee that you will achieve the same or similar results.

6. Client Responsibility

By purchasing or participating in Three Ascend services or products, you acknowledge that your results depend substantially on your own participation, honesty, implementation, and willingness to take action.

You are responsible for:

• Showing up fully and prepared

• Completing assigned work

• Making decisions in your business

• Implementing agreed-upon actions

• Communicating honestly

• Seeking clarification when needed

• Managing your calendar and commitments

• Maintaining your own records, files, passwords, systems, and business assets

• Obtaining professional advice from licensed advisors when appropriate

Three Ascend may provide strategy, structure, frameworks, technology, recommendations, and accountability, but you remain responsible for execution and final decisions.

7. Eligibility

Our services and products are intended for individuals who are at least 18 years old and legally able to enter into binding agreements.

By using our website, products, or services, you represent that you are at least 18 years old and have authority to enter into these Terms on your own behalf or on behalf of the business entity you represent.

8. Payment Terms

Fees for Three Ascend services or products will be provided in the applicable proposal, invoice, checkout page, sales page, agreement, app terms, or written communication.

Unless otherwise stated in writing:

• Payment is due according to the schedule provided at purchase or enrollment.

• You agree to pay all fees when due.

• Failure to make payment may result in suspension or termination of access to services, products, sessions, materials, or programs.

• Payment plans, if offered, are a convenience and do not reduce the total amount owed.

• You remain responsible for the full amount agreed upon unless otherwise stated in a written agreement signed or approved by Three Ascend.

For certain programs or engagements, Three Ascend may charge premium fees. The applicable fee, payment schedule, and deliverables for each program, product, or engagement will be clearly communicated before purchase or enrollment, including in a program-specific agreement where applicable.

9. Refunds and Cancellations

Because advisory, coaching, and consulting services involve reserved time, preparation, intellectual property, strategic guidance, and access to proprietary materials, all payments are generally non-refundable unless otherwise stated in writing.

Refund terms, if any, will be specified in the applicable agreement, invoice, checkout page, app terms, or written offer for that specific program or product.

Unless otherwise stated:

• Missed sessions are not refundable.

• Failure to participate does not entitle you to a refund.

• Failure to implement recommendations does not entitle you to a refund.

• Dissatisfaction with business results does not entitle you to a refund.

• Chargebacks or payment disputes made without first contacting Three Ascend may be considered a breach of these Terms.

Three Ascend reserves the right to review refund requests on a case-by-case basis but is not obligated to grant a refund unless required by law or written agreement.

10. Scheduling, Rescheduling, and Attendance

Clients are expected to attend scheduled sessions, calls, meetings, or program or community events on time.

Unless otherwise stated in writing:

• You are responsible for scheduling or attending sessions within the applicable engagement period.

• Missed appointments may be forfeited.

• Rescheduling requests must be made at least 24 hours in advance.

• Three Ascend may decline to reschedule repeated missed or late-cancelled sessions.

• Group program or community sessions may not be rescheduled for individual participants.

Three Ascend reserves the right to reschedule sessions due to illness, emergency, technical issues, or other reasonable circumstances.

11. SMS Messaging

Three Ascend uses SMS messaging primarily as a client-service tool for appointment reminders, confirmations and related service updates. By providing your phone number and opting in, you consent to receive SMS messages from Three Ascend. Consent is collected through clear affirmative action and is not obtained through pre-checked boxes.

Message Frequency & Rate

Message frequency may vary. Message and data rates may apply depending on your wireless carrier and plan. Contact your wireless provider for more information about your messaging or data plan.

Carrier Liability

Carriers are not liable for delayed or undelivered messages.

Opt-out

You may opt out at any time.

Reply STOP to any text message you receive from us. After you send STOP, you may receive a confirmation message confirming that you have been unsubscribed. After that, you will no longer receive SMS messages from us unless you opt in again. For assistance, reply HELP or contact us at [email protected].

We do not sell your mobile phone number. We do not share SMS opt-in data or consent with third parties for their marketing or promotional purposes. We may share limited SMS related information with service providers who help us send, manage or deliver text messages, but only necessary to provide services on our behalf.

12. Email Communications

By submitting your email address, scheduling a call, downloading resources, purchasing services, enrolling in a program, or otherwise communicating with us, you consent to receive transactional, service-related, and, where permitted, marketing communications from Three Ascend.

You may unsubscribe from marketing emails at any time by using the unsubscribe link in the email or contacting us at [email protected]. Transactional or service-related emails may still be sent where necessary to provide services, manage your account, or fulfill contractual obligations.

13. Intellectual Property

All content, materials, frameworks, templates, worksheets, recordings, trainings, videos, documents, graphics, systems, processes, software, application code, copy, website content, program materials, and other intellectual property provided by Three Ascend are owned by Three Ascend or licensed to Three Ascend unless otherwise stated.

You may not copy, reproduce, modify, publish, distribute, sell, license, teach, share, upload, transmit, reverse-engineer, or create derivative works from Three Ascend materials or products without prior written permission.

Your purchase, enrollment, or use of a Three Ascend product gives you a limited, non-transferable, non-exclusive license to use the materials or product for your personal or internal business use only.

You may not use Three Ascend materials or products to create competing services, programs, workshops, templates, courses, consulting offers, applications, or commercial products.

14. Confidentiality

During advisory, coaching, or consulting engagements, you may share sensitive business, personal, financial, operational, or strategic information. Three Ascend will make reasonable efforts to maintain the confidentiality of information shared in private advisory, coaching, or consulting contexts.

However, confidentiality does not apply to information that:

• Is publicly available

• Was already known before disclosure

• Is independently developed without use of confidential information

• Suggests risk of harm, fraud, abuse, or unlawful activity

• Is shared in group settings where other participants are present

If you participate in a group program, mastermind, workshop, or community, you agree to respect the confidentiality of other participants and not disclose their personal or business information without permission.

15. Group Program and Community Conduct

If you participate in a group program, mastermind, workshop, or community (such as Circle Mastermind), you agree to act respectfully, honestly, and professionally.

Three Ascend may remove any participant, without refund, if we determine that the participant:

• Harasses, threatens, or abuses others

• Disrupts the learning environment

• Violates confidentiality

• Misuses another participant's information

• Solicits participants inappropriately

• Engages in unlawful, deceptive, or unethical conduct

• Refuses to follow reasonable program or community guidelines

• Creates a harmful or unsafe environment
  

16. Testimonials, Reviews, and Marketing Use

If you provide a testimonial, review, success story, feedback, comment, screenshot, or other statement about Three Ascend, you grant us permission to use it for marketing, promotional, educational, or business purposes, unless you expressly request otherwise in writing.

We may edit testimonials for length, clarity, grammar, or formatting, but we will not intentionally alter the substance of your statement.

Where required, we will disclose material relationships, incentives, or compensation connected to testimonials or endorsements.

Testimonials reflect individual experiences and do not guarantee that other clients will achieve the same or similar results.

17. Website and Application Use

You agree to use our website and any Three Ascend application lawfully and appropriately. You may not:

• Attempt to hack, disrupt, damage, or interfere with the website or any application

• Use the website or any application for fraudulent or unlawful purposes

• Copy, scrape, or harvest website or application content without permission

19. Technology and Availability

Three Ascend is not responsible for delays, interruptions, data loss, technical issues, internet failures, platform outages, app marketplace issues, or other events outside our reasonable control.

22. No Professional Relationship Beyond Services Purchased

A formal advisory, coaching, or consulting relationship begins only when Three Ascend accepts you as a client and you complete the applicable enrollment, payment, or agreement process.

23. Termination

Three Ascend may terminate or suspend your access to services, products, programs, materials, or communities if you breach these Terms, fail to make payment, violate confidentiality, misuse intellectual property, engage in harmful conduct, or otherwise act in a manner inconsistent with the integrity of our work.

Termination does not relieve you of payment obligations incurred before termination.
